Another City in Pennsylvania Decriminalizes Marijuana Possession

YORK, PA — Another city in Pennsylvania has voted to make possession of small amounts of marijuana a fine-only offense.

Earlier this week, the York City Council voted to decriminalize the possession of under 30 grams of marijuana, reducing the penalty to a maximum fine of $100 and no jail time for first-time offenders.

A second offense within five years would result in a fine of $300, with a third carrying a $600 fine.  For those that can not afford to pay the fines, there is an option for offenders to perform community service instead.

Under state law, marijuana possession is a criminal misdemeanor that carried up to 30 days in jail, a $500 fine, or both.

York joins three of Pennsylvania’s largest cities — Philadelphia, Pittsburgh, and Harrisburg — in reducing penalties for simple marijuana possession, adding support to advocates who are pushing for statewide decriminalization, a policy change that is supported by Governor Tom Wolf, a Democrat.

New York City: Minorities Still Arrested Disproportionately for Marijuana Violations

NEW YORK, NY — Eighty-seven percent of low level marijuana arrestees in New York City are either African Americans or Latinos, according to an analysis compiled by the Marijuana Arrest Research Project and published this week by the Drug Policy Alliance.

Researchers reported that New York City police officers made more than 60,000 arrests for minor marijuana violations during the first three years of Mayor Bill de Blasio’s administration (2014-2016) – even though he had previously called the practice “unjust and wrong.”

Of those arrested during this period, 49 percent were black, 38 percent were Latino, nine percent were white, and four percent were classified as either Asian or ‘other.’

Similar racial disparities among low level marijuana arrests existed under the Giuliani and Bloomberg administrations.

Authors concluded, “In 2016, and for the last 30 years, the NYPD has had two very different patterns or systems of enforcement by race and ethnicity for the criminal offense of possessing small amounts of marijuana – separate, unequal, and unjust.”

Recent reviews of marijuana possession arrest data from New JerseyMaryland, and Virginia have identified similar trends. A 2013 American Civil Liberties Union study found that nationwide blacks are approximately four times as likely as whites to be arrested for marijuana possession, even though both ethnicities consume the substance at approximately similar rates.

Although New York state law classifies minor marijuana possession offenses as a non-criminal offense, separate penal law (NY State Penal Law 221.10) defines marijuana possession in a manner that is ‘open to public view’ as an arrestable offense.

Delaware Governor Signs Bill Making it Easier to Get Medical Marijuana for PTSD

DOVER, DE — Delaware residents suffering from post-traumatic stress disorder, or PTSD, will now have an easier time obtaining medical marijuana to treat their symptoms.

While PTSD was already a qualifying condition for medical marijuana in Delaware, Senate Bill 24, which was signed into law Wednesday by Governor John Carney, removes a requirement that patients needed to visit a psychiatrist in order to be certified for medical marijuana use.

Now, like patients suffering from other qualifying conditions, patients suffering from PTSD can now get their medical marijuana certification from any physician.

Senate Bill 24, also known as the Bravery Bill, was sponsored by Sen. Margaret Rose Henry (D-Wilmington).  As introduced, the will would have also allowed patients suffering from anxiety disorders access to medical marijuana, but that language was removed from the final bill.

The change to Delaware’s medical marijuana law takes effect immediately.

Tale of Two New Yorks as NYPD Continues Discriminatory Marijuana Arrests

NEW YORK, NY — The Marijuana Arrest Research Project will release a major report Tuesday, commissioned by the Drug Policy Alliance.

The report, Unjust and Unconstitutional: 60,000 Jim Crow Marijuana Arrests in Mayor de Blasio’s New York, shows that despite changing mayoral administrations and police commissioners, the NYPD continues to make large numbers of unjust and racially-targeted marijuana possession arrests.

Despite Mayor Bill de Blasio’s campaign promise to end racially-biased policing, marijuana possession was New York City’s fourth most commonly charged criminal offense in 2016.

Black and Latino New Yorkers continue to comprise 85 percent of the more than 60,000 people arrested for low-level marijuana possession on Mayor de Blasio’s watch. Most people arrested are young Blacks and Latinos – even though studies consistently show young Whites use marijuana at higher rates.

The new report shows that the NYPD targets Blacks and Latinos for marijuana misdemeanor enforcement all over New York City. One key finding is that in many neighborhoods where Blacks and Latinos constitute a small minority of the residents, they are arrested in much higher numbers than Whites.

The NYPD arrests Black New Yorkers at 10 times the rate of Whites in Manhattan and 15 times the rate of Whites in Staten Island.

The report includes extensive analyses of marijuana arrest data from the New York State Division of Criminal Justice Services and demographic data for all five boroughs.

The full report will be released at noon Tuesday.

West Virginia’s Medical Marijuana Law Takes Effect

CHARLESTON, WV — West Virginia’s limited medical marijuana law officially took effect this week, although patients will not benefit from the new law for two more years.

Passed earlier this year and signed into law by Governor Jim Justice in April, Senate Bill 386, also known as the West Virginia Medical Cannabis Act, will allow seriously ill patients to access medical marijuana if their doctors recommend it once the program is up and running.

Qualified patients will be allowed to access cannabis-infused products, such as oils, pills and tinctures, but will not be allowed to grow their own cannabis or possess marijuana in herbal form, similar to medical marijuana programs up and running in Minnesota and New York, as well as those that are coming soon in LouisianaPennsylvania and Ohio.

Patients may qualify for medical cannabis if they have a terminal illness or if they suffer from cancer, HIV/AIDS, ALS, Parkinson’s disease, multiple sclerosis, spinal cord damage, epilepsy, neuropathies, Huntington’s disease, Crohn’s disease, post-traumatic stress disorder, intractable seizures, sickle cell anemia, or “severe chronic or intractable pain in which conventional therapeutic intervention and opiate therapy is contraindicated or has proved ineffective as determined as part of continuing care.”

Once the program is operational, patients will be allowed to possess a 30-day supply of medical marijuana products, although state regulators have yet to define what constitutes a “30 day supply.”  The only types of medical cannabis allowed initially are pills, oils, gels, creams, ointments, tinctures, liquid, and non-whole plant forms for administration through vaporization.

Dispensaries will not be allowed to sell marijuana-infused edibles, but cannabis products could be mixed into food or drinks by patients themselves. Vaporization f oils) is allowed, but smoking is prohibited.

Under the new law, the West Virginia Department of Health and Human Resources Bureau for Public Health will be charged with oversight of the program, including by developing rules, inspecting medical cannabis businesses, processing applications, and issuing patient ID cards and business licenses.

The state will issue up to 10 medical cannabis grower permits, with up to two locations each, up to 10 processor permits, and no more than 30 dispensary permits.  Applicants will pay $2,500 per dispensary application and $5,000 per grower or processor application. Registration fees are $10,000 for each dispensary location and $50,000 for grower and processors.

The state is required to begin issuing patient identification cards by July 1, 2019. Patients will be charged $50 for an identification card, but the fee can be waived for those with financial hardships.

Delaware Creates Marijuana Legalization Task Force

DOVER, DE — The General Assembly passed a concurrent resolution Saturday morning to create a task force that will study regulating and taxing marijuana for adult use in Delaware.

The Adult Use Cannabis Task Force “shall study adoption of a model for regulation and taxation of adult-use cannabis in Delaware, including local authority and control, consumer safety and substance abuse prevention, packaging and labeling requirements, impaired driving and other criminal law concerns, and taxation, revenue, and banking issues.”

It will hold its first meeting no later than September 7, 2017, and it must report its findings and recommendations to the governor and the General Assembly by January 31, 2018.

“The General Assembly is ready to take a serious look at regulating and taxing marijuana for adult use,” said Maggie Ellinger-Locke, legislative counsel for the Marijuana Policy Project. “This is an opportunity for a variety of stakeholders to come together and examine every aspect of this issue. We hope it will pave the way for the General Assembly to adopt a more thoughtful approach to cannabis next session. Lawmakers can see the direction the country is moving on this issue and they know most Delaware voters support making marijuana legal for adults.”

The 23-member task force will be co-chaired by Sen. Margaret Rose Henry and Rep. Helene Keeley, Democrats who sponsored legislation this year to regulate and tax marijuana like alcohol for adults 21 and older. It will also include:

  • a state senator and a state representative from the minority caucus, appointed by the Senate president and House speaker, respectively;
  • the Secretary of the Department of Finance;
  •  the Secretary of the Department of Natural Resources and Environmental Control;
  • the Secretary of the Department of Safety and Homeland Security;
  • the Director of the Division of Public Health;
  • the Director of the Division of Substance Abuse and Mental Health;
  • the State bank commissioner;
  • the Attorney General;
  • the Chief Defender, Office of Defense Services;
  • the Mayor of the City of Wilmington;
  • the Chair of the Medical Marijuana Oversight Committee;
  • a marijuana policy reform advocate and a medical marijuana industry representative, both appointed by the Governor;
  • a physician with experience recommending treatment with medical marijuana, appointed by the Medical Society of Delaware
  • the President of the Delaware League of Local Governments;
  • the Chair of the Delaware Police Chiefs’ Council;
  • the Chair of the Employer Advocacy Committee of the Delaware State Chamber of Commerce;
  • a representative of AAA Mid-Atlantic; and
  • a pharmacist, appointed by the President of the Delaware Pharmacist Society.

More than 60% of Delaware voters support making marijuana legal, according to a September 2016 poll by the University of Delaware Center for Political Communication.

Eight states have enacted laws regulating marijuana for adult use: Alaska, California, Colorado, Maine, Massachusetts, Nevada, Oregon, and Washington. In the District of Columbia, voters enacted a law making personal possession and home cultivation legal for adults 21 and older.

Delaware removed criminal penalties for personal possession of small amounts of marijuana in 2015.

Pennsylvania Awards 27 Medical Marijuana Dispensary Licenses

HARRISBURG, PA — Pennsylvania residents are one step closer to being able to access medical marijuana.

The Pennsylvania Department of Health on Thursday granted the first 27 permits for medical marijuana dispensaries. Those who won the coveted permits now have six months to become operational, before they can begin dispensing medical marijuana.

“This has been a highly competitive process and the department received hundreds of quality applications,” said John Collins, Director of the Office of Medical Marijuana. “Once this program is fully operational, patients with serious medical conditions will have locations throughout the commonwealth where they can purchase medication to help in their treatment. We remain on track to provide medication to patients in 2018.”

There will be a total of 52 dispensaries located throughout the commonwealth. While each of the 27 dispensary permit holders is eligible to open a total of three locations, some dispensary permit holders have opted not to open all eligible locations at this time, according to the Department of Health.

The Office of Medical Marijuana received 457 applications: 177 for growers and processors; and 280 for dispensaries.

The Medical Marijuana Act was signed into law by Governor Tom Wolf on April 17, 2016 and became effective a month later.  

Pennsylvania’s medical marijuana program is expected to be fully implemented by early 2018.
